UNHCR: "All transfers to Bulgaria should be halted due to a real risk of inhuman or degrading treatment."

On 2 January 2014, UNHCR concluded in its Observations on the Current Situation of Asylum in Bulgaria that asylum seekers “in Bulgaria face a real risk of inhuman or degrading treatment, due to systemic deficiencies in reception conditions and asylum procedures” and calls upon all EU Member States to suspend all transfers to Bulgaria under the Dublin Regulation, in accordance with jurisprudence of both the Court of Justice of the European Union and the European Court of Human Rights.

UNHCR highlights that practice has shown that persons who have applied for asylum in Bulgaria are at risk of being subjected to arbitrary detention, given the absence of a legal basis in Bulgarian law and detention for uncertain and lengthy periods of time. Contrary to jurisprudence of the European Court of Human Rights, an amendment to the Bulgarian Law on Asylum and Refugees was proposed in November 2013 to allow for the systematic detention of asylum seekers in closed centres.

Center for Legal Aid - Voice in Bulgaria fully supports the statements announced by the Bulgarian Helsinki Committee and the Foundation for Access to Rights /FAR/ in regard to the proposed by the Council of Ministers amendments in the Law on refugee and asylum. In the proposed text there are inadmissible severe antinomy with basic international principles of the asylum legislation which are also in breach with some basic human rights. Every amendment in the legislation should be done after broad consultations with other institutions, NGOs and experts in the field corresponding to the democratic order in every constitutional state. We call upon the Bulgarian government to initiate an active discussion and rethink the so proposed amendments.

This Saturday, 22.06.2013, the UNHCR for Bulgaria together with the Bulgarian Red Cross are organizing a multicultural event in the Sofia city South park that would take place between 10:00 and 14:00. Join them in order to spent great time in singing, dancing and other activities promoting the cultural differences within the refugees in Bulgaria. By going there you would be able to see the UNHCR special exhibition "The most important thing" representing refugee stories from Central Europe describing the most important thing they have taken with themselves once they were forced to leave their homes. CLA "Voice in Bulgaria" would be attending the event as well and we hope to meet you there!
